\u00a0 <\/strong><\/em>\u00a0 “<\/strong><\/span>We’re relying on this process and the law and courts to protect us: we the people, we are the citizens here. As a tribal member I have dual citizenship and they did recognize that. \u00a0Indian and civil law is crossing over in some ways.”<\/span> ~ Myron Dewey<\/a>,\u00a0Digital Smoke Signals<\/a><\/em><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Dewey\u00a0broadcasts live\u00a0<\/em>from the <\/span>Morton County Sheriffs\/Mandan Police Department<\/a>\u00a0<\/strong>(they share a single headquarters)<\/em> alongside two<\/span> “intellectual warriors”<\/span> – lawyers who are advising him,<\/span><\/span>\u00a0Jim Fennerty<\/a> from Chicago and\u00a0<\/span>Angela Bibens<\/a><\/em>\u00a0from Colorado<\/span><\/em>, to retrieve his drone which was confiscated and\u00a0to file a criminal complaint<\/em>\u00a0regarding<\/span> the theft<\/em> of his drone on October 8, 2016<\/a>. \u00a0<\/em>The complaint is also in regard to\u00a0a helicopter that looks like a police helicopter that was violating the 100-foot flyover space.<\/span><\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0Lead Investigator of Morton County Sheriff’s Department,<\/span> Captain Jay\u00a0Gruebele<\/a>, comes to meet them & tells them immediately<\/em>\u00a0they won’t be getting the drone back today:<\/span> “Our police department is applying for a search warrant to see the SD card in it.”<\/span><\/span><\/strong><\/span><\/p>\n

Dewey:<\/span>\u00a0“We were told on video that he had a search warrant to go into the video and retrieve the drone from the vehicle … That officer’s name was Jonathan Mall<\/em>.”<\/span> \u00a0Dewey explains the officer\u00a0didn’t identify himself,<\/em> but\u00a0the paperwork<\/em> does<\/em>\u00a0identify\u00a0the officer who took the drone as<\/span> “badge #54<\/em>“.<\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Dewey asks for the drone back if the PD keeps the memory card but the captain informs them that this is a decision up to the State’s attorney and that he has no idea what the time frame on that would be, but that<\/span> “In any case, you won’t be getting the drone back today.”<\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Dewey informs the Captain\u00a0that in that case<\/em> they’ll be filing charges for theft<\/em> and<\/span> “We have a visual of aircraft violating AFA rules going beyond its 100 foot mark.”<\/span><\/strong><\/span><\/p>\n

Captain Gruebele<\/a> responds:<\/em><\/span> “<\/span><\/span>It’s not a police helicopter, we don’t own a police helicopter. \u00a0We don’t rent<\/em> one either.”<\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Dewey files the complaint of theft<\/em> with<\/span>\u00a0Captain Gruebele<\/a>, & reports that that he and two family members<\/em>\u00a0were being followed by police officers as they were driving, & that they voluntarily pulled over<\/em>\u00a0& asked if the officers needed anything. \u00a0The police asked for IDs & registration\u00a0which the party declined<\/em> since this wasn’t a stop. \u00a0Then other police officers pulled over, called Dewey by his name, and told them they had a warrant to inspect the vehicle and take the drone.<\/em>\u00a0 They wouldn’t identify themselves or<\/em> prove a warrant. \u00a0About 7 police cars with 14 officers blocked off every corner and exit.<\/em> They had all covered their badge numbers and wouldn’t identify themselves so<\/span> Dewey<\/a> didn’t know if they were DAPL security or not.<\/span><\/strong><\/span><\/p>\n

Myron<\/a><\/span>:<\/span> \u00a0“They went into the vehicle with no consent, so they stole the equipment. \u00a0Jonathan Mall stole the equipment.<\/em>“<\/em><\/span><\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 <\/span><\/span>What was reported by<\/span> Dewey<\/a> to have been stolen <\/span><\/em>includes: a<\/span> Phantom 4 Drone<\/a> in pristine condition- brand new.<\/em>\u00a0 It had three battery packs, a few cords, the drone itself with SD card, and was fully connected with the remote,\u00a0<\/em>&\u00a0was in the carrying case. \u00a0The estimated value is $2000 and a 64 G SD card.<\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Dewey<\/a>\u00a0informs the officer that he’s a licensed drone operator<\/em>, & the officer argues that if he was flying it above someone else-\u00a0there’s a<\/em>\u00a0problem.<\/span> Dewey<\/a> maintains that his property is stolen. \u00a0The captain says he is going to draw up the report and send it to<\/span> the State Attorney<\/a>.<\/strong><\/span><\/p>\n

\u00a0 \u00a0\u00a0Dewey shows the tail\u00a0number: N283BH,<\/em> and urges the FB Live audience to look up the number (registered to ABC Helicopters, inc., President John Hare<\/em>).\u00a0<\/a>\u00a0He says there are several of these helicopters,<\/em>\u00a0& once he gets tail numbers he’ll file reports for each of them.<\/span><\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 When they finish the report, <\/span>Dewey<\/a> asks for the officer’s information: name, phone number, badge number<\/em><\/span><\/strong>.<\/em>\u00a0 He also wants the officer to clarify the last officer’s written identification<\/em> who refused to clarify it, but instead of answering, the officer told<\/span> Dewey<\/a> “not to loiter”. He identifies the number on the paperwork as<\/span> “59.”<\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Update on 27 arrested today. \u00a0Anonymous woman with bandana around face recounts what she witnessed:<\/span> “ceremony”, “officers approach in riot gear”, “people arrested”<\/span>. \u00a0She explains they are<\/span> “protectors” not<\/span> “protesters”<\/span>. \u00a0<\/span><\/span><\/span><\/span><\/strong><\/p>\n

\u00a0 \u00a0 A second man is interviewed explaining he witnessed a ceremony that was <\/span>interrupted<\/span><\/span>\u00a0by officers defending pipeline that endangers 18 million people downstream. \u00a0He says its time to stand up & say<\/span> “No. \u00a0Its time to stop our addiction on oil.” \u00a0He says<\/span> “that line is being drawn at Standing Rock.”<\/span> \u00a0He explains DAPL crosses the Missouri River twice & crosses four states. \u00a0He says they are there<\/span> “in good will to the officers”<\/span> because they are<\/span> “there in ignorance.”<\/span> \u00a0He explains<\/span> “leaks are inevitable,”<\/span> and that<\/span> “the people of Standing Rock would have a one hour’s notice before their water supply is destroyed when the pipeline breaks.”<\/span> \u00a0He urges people to contact their Senator & to find petitions & sign them, & to donate to Water Protectors. \u00a0<\/span><\/span><\/span><\/span><\/strong><\/p>\n

\u00a0 \u00a0 Myron<\/a>, outside the jail, explains no one is allowed inside & that they are “waiting”<\/span> for the 27 arrested to get out. \u00a0He then interviews a second man with “Veterans for Peace”<\/span> who says the people were peaceful. \u00a0He explains the officers came in with force, & “separated people”<\/span>. \u00a0He said the officers were more aggressive on the side of the road, but that they were \u00a0peaceful. \u00a0<\/span><\/span><\/span><\/span><\/strong><\/p>\n

\u00a0 \u00a0 \u00a0Myron<\/a> interviews a third gentleman, who says that the officers arrested some people mostly for “intimidation purposes”<\/span>. \u00a0He explains the officers told them that they were “not permitted to shake peoples’ hands.”<\/span> \u00a0The man explains the ceremony was beautiful & peaceful. \u00a0He says officers blamed them for a head-on accident. \u00a0Both<\/span> Myron<\/a> & the gentleman agree the officers are fabricating evidence. \u00a0Myron explains the officers stole his drone that day.<\/span><\/span><\/span><\/span><\/strong><\/p>\n

\u00a0 \u00a0\u00a0Myron<\/a>\u00a0interviews a woman named Nicole (Bad Brave?) from the<\/span> Three Affiliated Tribes<\/a>, who explains she is frustrated & just “needs to be here”<\/span>. \u00a0She begins to cry because the situation is very emotional.\u00a0<\/span><\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Myron encourages movie stars to all come to the camp. \u00a0A third woman is interviewed explains she is with the medic camp & they they are working to make sure\u00a0everyone\u00a0<\/em>is well taken care of. \u00a0<\/strong><\/span><\/p>\n

\u00a0 \u00a0 Myron<\/a>\u00a0performs a prayer, & then a woman approaches & explains that Morton County officer is giving a public announcement stating that the protesters were\u00a0not<\/em><\/span> peaceful. \u00a0Myron then turns on the interview.<\/span> \u00a0(see full video he watches below)<\/span><\/em>.\u00a0<\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 \u00a0 After the video,<\/span>\u00a0Myron<\/a> encourages officers who are watching<\/span>\u00a0Myron<\/a>‘s\u00a0<\/em>video that they need<\/span> “another<\/em><\/span> officer besides\u00a0that guy\u00a0<\/em>to give public announcements.”<\/span> \u00a0 He explains that the officer’s report fabricated information, & that giving false information is\u00a0not okay. \u00a0<\/em><\/span>Myron<\/a>\u00a0explains false reporting by officers is\u00a0too common\u00a0<\/em>and\u00a0not<\/span> okay<\/span>.<\/em><\/span><\/span><\/strong><\/span><\/p>\n
