Live from Morton County Sheriff Department<\/a>:<\/strong><\/span><\/p>\n

\u00a0 <\/span><\/strong><\/em>\u00a0 “<\/span><\/strong>We’re relying on this process and the law and courts to protect us: we the people, we are the citizens here. As a tribal member I have dual citizenship and they did recognize that. Indian and civil law is crossing over in some ways.<\/span>” ~ Myron Dewey<\/a>,\u00a0Digital Smoke Signals<\/a><\/em><\/span><\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Dewey\u00a0broadcasts live\u00a0<\/em>from the Morton County Sheriffs\/Mandan Police Department<\/a><\/span>\u00a0<\/span><\/span><\/span><\/strong>(they share a single headquarters)<\/em><\/span><\/span><\/span> along with two “intellectual warriors” – lawyers who are advising him:<\/span> Jim Fennerty<\/a> from Chicago and<\/span>\u00a0Angela Bibens<\/a>, an attorney from Colorado, to retrieve his drone property which was confiscated by an officer as well as to file a criminal complaint<\/em>\u00a0regarding the theft<\/em> of his drone on October 8, 2016<\/a> and<\/em> of a helicopter that looks like a police helicopter that was violating the 100-foot flyover space.<\/span><\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Captain\u00a0Grubbily comes to meet them and tells them immediately that they won’t be getting the drone back today, in fact: “<\/span>Our police department is applying for a search warrant to see the SD card in it.<\/span>“<\/span><\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 Dewey:<\/span>\u00a0“We were told on video that he had a search warrant to go into the video and retrieve the drone from the vehicle … That officer’s name was Jonathan Mall<\/em>.<\/span>” \u00a0Dewey explains that the officer\u00a0didn’t identify himself,<\/em> but\u00a0the paperwork<\/em> does\u00a0<\/span>identify<\/span>\u00a0the officer who took the drone as “badge #54<\/em>“.<\/span><\/span><\/strong><\/p>\n

\u00a0 \u00a0 Dewey asks for the drone back if the PD keeps the memory card but the captain informs them that this is a decision up to the State’s attorney and that he has no idea what the time frame on that would be, but that “In any case, you won’t be getting the drone back today.<\/span>“<\/span><\/span><\/strong><\/p>\n

\u00a0 \u00a0 Dewey informs the Captain\u00a0that in that case<\/em> they’ll be moving on to the next step:\u00a0filing charges for theft<\/em> and “We have a visual of aircraft violating AFA rules going beyond its 100 foot mark<\/span>“.<\/span><\/span><\/strong><\/p>\n

Captain Grubbilyn responds:<\/em> “It’s not a police helicopter, we don’t own a police helicopter. \u00a0We don’t rent<\/em> one either.<\/span>“<\/span><\/span><\/strong><\/p>\n

\u00a0 \u00a0 Dewey files the complaint of theft<\/em> with Captain Groobily, & reports that that he and two family members<\/em>\u00a0were being followed by police officers as they were driving, & that they voluntarily pulled over<\/em>\u00a0& asked if the officers needed anything. \u00a0The police asked for IDs & registration\u00a0which the party declined<\/em> since this wasn’t a stop. \u00a0Then other police officers pulled over, called Dewey by his name, and told them they had a warrant to inspect the vehicle and take the drone.<\/em>\u00a0 They wouldn’t identify themselves or<\/em> prove a warrant. \u00a0About 7 police cars with 14 officers blocked off every corner and exit.<\/em> They had all covered their badge numbers and wouldn’t identify themselves so Dewey<\/a> didn’t know if they were DAPL security or not<\/span>.<\/span><\/span><\/strong><\/p>\n

Myron<\/a>:<\/span> \u00a0“They went into the vehicle with no consent, so they stole the equipment. \u00a0Jonathan Mall stole the equipment.<\/em><\/span>“<\/em><\/span><\/span><\/strong><\/p>\n

\u00a0 \u00a0 What was reported by Dewey<\/a> to have been stolen <\/em>includes: a<\/span> Phantom 4 Drone<\/a> in pristine condition- brand new.<\/em>\u00a0 It had three battery packs, a few cords, the drone itself with SD card, and “was fully connected with the remote as well”.<\/em>\u00a0 It was in the carrying case. \u00a0The estimated worth is $2000 and a 64G SD card.<\/span><\/span><\/strong><\/p>\n

\u00a0 \u00a0 Dewey<\/a>\u00a0informs the officer that he’s a licensed drone operator<\/em>, & the officer argues that if he was flying it above someone else- then there’s a<\/em>\u00a0problem. Dewey<\/a> maintains that his property is stolen. \u00a0The captain says he is going to draw up the report and send it to the State Attorney<\/a>.<\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0\u00a0Dewey shows the tail\u00a0number: N283BH<\/span>,<\/em> and urges the FB Live audience to look up the number (registered to<\/span> ABC Helicopters, inc., President John Hare<\/em><\/span>)<\/span>.\u00a0<\/a>\u00a0He says there are several of these helicopters,<\/em>\u00a0& once he gets tail numbers he’ll file reports for each of them.<\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 When they finish the report, Dewey<\/a> asks for the officer’s information: name, phone number, badge number<\/em><\/span><\/strong>.<\/em>\u00a0 He also wants the officer to clarify the last officer’s written identification<\/em> who refused to clarify it, but instead of answering, the officer told Dewey<\/a> “not to loiter”. He identifies the number on the paperwork as “59.”<\/span><\/strong><\/span><\/p>\n
