&nbsp;&#8220;Stalking&#8221; charges against <a href=\"https:\/\/www.facebook.com\/myron.dewey1\">Myron Dewey<\/a> of<\/span><a href=\"https:\/\/www.facebook.com\/DigitalSmokeSignals\/\"> Digital Smoke Signals<\/a> <\/strong><\/span><span style=\"font-size: 14pt; color: #0000ff;\"><strong>were dismissed Monday at the request of the prosecutor.&nbsp;<\/strong><\/span><\/p>\n<div class=\"subscriber-preview\">&nbsp;<\/div>\n<div class=\"subscriber-preview\">\n<p class=\"\"><span style=\"font-size: 14pt;\"><strong><span style=\"color: #0000ff;\">&nbsp; &nbsp; &nbsp;Myron was accused of stalking unlicensed private pipeline security workers by taking video of them with his drone. &nbsp;A Morton County Sheriff&#8217;s Office affidavit said Dewey flew over two unnamed people working for<\/span> <a href=\"https:\/\/www.bbb.org\/south-east-florida\/business-reviews\/security-guard-and-patrol-service\/leighton-security-management-in-stuart-fl-90012863\">Leighton Security<\/a> <span style=\"color: #0000ff;\">and tried to capture their faces and license plates to post online.<\/span><\/strong><\/span><\/p>\n<\/div>\n<div class=\"subscriber-only\">\n<p class=\"\"><span style=\"font-size: 14pt; color: #0000ff;\"><strong>&nbsp; &nbsp; &nbsp; He pleaded not guilty to a misdemeanor stalking charge and was scheduled for trial on Wednesday.&nbsp;<\/strong><\/span><\/p>\n<div class=\"subscriber-only\">\n<p class=\"\"><span style=\"font-size: 14pt; color: #0000ff;\"><strong>&nbsp; &nbsp; &nbsp; &nbsp;Monte Rogneby, attorney for the Private Investigation and Security Board, confirmed there is no Leighton Security company licensed in the state. &nbsp;He said there is no lawsuit pending against them, as there is with TigerSwan.<\/strong><\/span><\/p>\n<\/div>\n<div class=\"subscriber-only\">\n<p class=\"\"><span style=\"font-size: 14pt; color: #0000ff;\"><strong>&nbsp; &nbsp; &nbsp; Morton County Assistant State&#8217;s Attorney Brian Grosinger wrote in a motion filed Monday that his reason for dropping stalking charge was that the judge ruled to suppress evidence taken from the drone.&nbsp;<\/strong><\/span><\/p>\n<\/div>\n<div class=\"tnt-ads-container text-center\">&nbsp;<\/div>\n<div class=\"subscriber-only\">\n<p class=\"\"><span style=\"font-size: 14pt; color: #0000ff;\"><strong>&nbsp; &nbsp; &nbsp; Judge Allan Schmalenberger wrote in an order on July 5 that the prosecutors did not provide enough evidence that search and seizure of the unmanned aerial device was legal.&nbsp;<\/strong><\/span><\/p>\n<\/div>\n<div class=\"subscriber-only\">\n<p class=\"\"><span style=\"font-size: 14pt; color: #0000ff;\"><strong>&nbsp; &nbsp; &nbsp;&#8220;<span style=\"color: #800000;\">Although the state asserts reasons in their brief, they submit no competent evidence to support it,<\/span>&#8221; he wrote.&nbsp;<\/strong><\/span><\/p>\n<\/div>\n<div id=\"tncms-region-article_instory_middle\" class=\"tncms-region hidden-print\"><span style=\"font-size: 14pt;\"><strong>&nbsp;<\/strong><\/span><\/div>\n<div class=\"subscriber-only\">\n<p class=\"\"><span style=\"font-size: 14pt;\"><strong>&nbsp; <span style=\"color: #0000ff;\">&nbsp; &nbsp;Dewey wrote in an affidavit that officers stopped his truck on County Road 83 and took the Phantom 4 drone without a warrant or placing him under arrest.&nbsp;<\/span><\/strong><\/span><\/p>\n<\/div>\n<div class=\"subscriber-only\">\n<p class=\"\"><span style=\"font-size: 14pt; color: #0000ff;\"><strong>&nbsp; &nbsp; &nbsp; &#8220;<span style=\"color: #800000;\">I did not give consent to any officer permitting them to seize my drone and controller; when I saw that they were seizing my property, I objected repeatedly to their seizing my property without a warrant,<\/span>&#8221; Dewey wrote.&nbsp;<\/strong><\/span><\/p>\n<\/div>\n<div class=\"subscriber-only\">\n<p class=\"\"><span style=\"font-size: 14pt; color: #0000ff;\"><strong>&nbsp; &nbsp; &nbsp; Grosinger argued in his brief that officers already suspected Dewey was using the drone to violate the law and that the seizure fell under <a href=\"http:\/\/www.uscourts.gov\/about-federal-courts\/educational-resources\/about-educational-outreach\/activity-resources\/what-does-0\">exceptions to the Fourth Amendment<\/a>.&nbsp;<\/strong><\/span><\/p>\n<\/div>\n<div class=\"subscriber-only\">\n<p class=\"\"><span style=\"font-size: 14pt; color: #0000ff;\"><strong>&nbsp; &nbsp; &nbsp; &#8220;<span style=\"color: #800000;\">Had they been required to obtain a warrant, the defendant could have destroyed evidence contained within the UAV&#8217;s memory,<\/span>&#8221; the prosecutor wrote.&nbsp;<\/strong><\/span><\/p>\n<\/div>\n<\/div>\n<p style=\"text-align: right;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #0000ff;\"><em>&nbsp;&#8220;<span style=\"color: #800000;\">I broke all the rules, but I did not break the law,<\/span>&#8221;
